Nah, because on all the Jags and Land Rovers I've seen, the Rear Fog Lights are sunk into the rear bumper and away from where the brake lights are. Besides, all american cars have a third brake light, which being off should help indicate they MIGHT not have their brakes lights LOCKED on when you drive behind them for a while. So I don't really see how it would cause confusion when they brake considering 3 other bright red lights come on. And if you think those rear fogs are confusing, what about Volvo's whose rear red lights are as bright as braking lights and then when they brake get twice as bright! It's almost blinding... Definately keeps you off their tail (not that I tailgate ever).
