I don't know how they test emissions in New Hampshire, but in Illinois the first thing that they look at is the "Readiness" flag that is part of the OBD-II system. Basically, you can't just reset the "Check Engine" light and drive over to a testing station - it has to go through a certain number and lengths of startup and drive sequences to set the Readiness flag. If the flags are not "ready for testing", they will reject your car and tell you to come back in a few days (had this experience).
Have you tried resetting the code and seeing if it comes back? If it doesn't come back after a certain amount of time, then what your indy said might fly. On the other hand, if it does you will probably need to get the O2 sensor replaced. I still don't know where the rear sensor is on a 9000 (my cars have not had them), but if it's easy to access, you might want to see how easy it will come out. The sensors come with a dab of antisieze on them and they were not to hard to take out of my Audis once I could get a wrench on them (on one car they were on TOP of the exhaust pipe which is of course under the car). And you don't really need the expensive O2 sensor, especially for the rears that don't do anything other than check the status of the cats; I have used both a 4-wire Bosch sensor for a Chrysler Concord (was about $40, requires wire splicing) and a "universal" Bosch sensor (slightly more) with good results.
