The seller is just being lazy or stupid IMHO. He can sell the car to anyone, anywhere in the US. The issue, I think, is probably the collection and reporting of sales tax. And maybe whether the title is really clear or not.
You pay the auto sales tax of the state in which you REGISTER the car. You would bring the bill of sale with you when you register the car in NY, and NY will charge you whatever your local sales tax rate might be, in addition to the usual registration (plates) and "user" fees, etc.
If you were to buy a car in CT from a dealer, the sales tax issue (whether you pay CT tax to the dealer or not) boils down to whether CT has a reciprocal agreement with NY State. If it does, you pay the CT sales tax on the dealer's bill of sale when you buy the car, and you bring the proof of that tax payment with you when you register the vehicle in NY. Whatever, you end up paying the NY State rate.
We live in NY and recently bought a Saab fom a MA dealer. We paid the MA tax, and when we handed over the form to the NYS DMV, we also had to pay the difference between the MA rate and the NY rate, as the NY rate was a bit higher (big surprise!)
