My tire shop will not rotate the tires if I'm even approaching the wear limit. Company policy, liability-based (but I'm sure it's also to steer you into a set of new tires). I doubt the state regulations get that specific.
I've quite often had the tires flipped on the rims to even out wear ('02 9-5 Aero SW was a tire-chewing monster). I had a local used-tire shop do this for maybe $10/tire. This includes balancing. They would also patch tires if my plugs didn't hold ($10).
My advice - find a hole-in-the-wall tire shop and pay cash. If you feel the tires are safe, why not get the most out of them?
