Would the passenger airbag even deploy if there was no passenger ? The driver's side - in the steering wheel could be checked fairly easily and a complaint filed if missing, but since the side deployed the system was working and likely would have had a light lit if driver/passenger was missing. Specific forces can deploy specific airbags only.
The classic collision I'll always recall was my dumb a** boss in the 80s driving her Saab 900 directly into a bridge abutment at probably 45 mph, it happened after work and this stupid useless s*b took the same route home as I was maybe 10 minutes behind her, she emerged from the wreck uninjured and was able to fully open the driver's side door. I heard her telling the police that her briefcase slid off the seat and she was reaching down to pick it up when she slammed in the abutment.
What a complete waste of a human being.
