Hi Clay, I was in a situation similar to this but the roles where reversed… I was the caller; this lady was a passing drivers on the shoulder, double yellows and stopping at red lights to put on make-up…. So I knew this lady was not in an emergence. Well I called central and give them the plate numbers, make and model of car, the police and I caught up with her they stopped her and all they could is have me sign a complaint, because they did not witness this going on they could not give her a ticket at all, just take a complaint, so did I signed a complaint and went to court where the old as hell judge that knew her and her lawyer got the whole thing tossed out of court… So what happened I took a day off from work and she walked away scott free…. Well here’s a Kick in the teeth I saw her doing it again but this time she hit a school bus and a tree, I got to call 911 for the police this time. I waited on the side of the road and my good buddy officer Goldsmith who took the complaint showed up and took my view of things, and I got to go before the Gutless Judge that toss us out of court the first time, this time charged her with every thing he could.
Well here’s the thing you need to do. The off duty sheriff that saw this happen could have given you a ticket they do have that power. The officer that did give you a ticket could not do so since he did not see you do this. You need to get a lawyer & fight this in court; the best thing to hope for is that the sheriff does not come to court. If he does not come then the officer has no leg to stand on. He can not answer any questions that you or the judge may have because that would all be HEAR SAY, and everyone knows that hearsay is inadmissible.
At the very least your lawyer should be albe to get the points reduced or even get them off with just a fine. If it has been seven years and No Tickets this should be easy to get done. My Dad ended up paying a lawyer here in New Jersey two hundred dollars a point that he could get taken off and he got it down to 0 points just a fine had to be paid I he got two tickets a week apart from each other.
