Are you getting the actual title to the car or is there a payoff and the lender or lease company has the title?

If the seller has the actual title, pay them upon exchange. Some sellers are suspicious of you and want cash or a cashiers check which you only give them when you have the car and the actual title in hand. Take the 1) title and 2) Smog certificate (many private sellers won't smog their cars before sale although it is technically the sellers resposibility, but don't push that point as it's often usual and customary for the buyer to smog car purchased from a private party and to consider the expense part of the purchase) to the DMV and they will mail you a new title in a couple of weeks.

If the seller has a balance or a payoff then the lender has the title then it gets tricker. You can pay his lender directly with intructions to send the title to you. Depends on whether the balance owed is more or less than the selling price.

If you are financing the car you're purchasing from a private party the lender will assist in getting the car properly titled, many have their own DMV departments.

Are you at all suspicious of the seller? Normally private parties can instill confidence as you see their houses and their lives and you realize they are not out to cause you or themselves any grief. Other times your BS detector goes off, listen to your BS detector, it's usually right.
