1. I don't know.
2. I live in WI (see lot's of 'em) and hunt them (see them up close) and FWIW they are unpredictable critters. They can be spooked by the most inoccuous noises (fabric on fabric) and yet indifferent to rather alarming noises (gunshot). How long individual animals survive has more to do with wariness than "intelligence" IMHO. Then there are those just "caught" out in front of you (blind corner or running across your path) - it's mostly chance and reaction time whether you hit one. And the rest? The youngin's not afraid of anything yet(including cars); naive enough to walk up to the occasional hunter (another story). So, do I think whistles work? No, but for $5 who cares. Would I let my guard down because of whistles? Hell no, best to just learn to spot the buggers at a glance (Look out at far reach of headlights and the shoulders, both sides, for waist high eyes on dark horizontal lines i.e. their back. Don't focus on immediate surroundings - it's too late at that point).
