Key FOB Behavior

I purchased a 2004 9-3 Aero CPO in November. The car seems great, but there is a really annoying behavior with both of my key fobs. I did a search first, and it seems that a number of people have problems with these things, but I haven't seen a description of my exact behavior. I can stand by my car and repeatedly lock and unlock my car with the fob and it works about 6 or 7 times then stops. I either have to just put the fob into the ignition for a few seconds, or sometimes have to start the car and then remove it and then the fob starts working again. Both fobs behave the exact same way. I also tried putting new batteries in and did the resynchronization. Same behavior.
Is this behavior fixed with the fob recall that I have been reading about? I almost bought the comments (can't remember where I read them) that if the fob is repeatedly tried away from the car, that it is disabled as a theft deterrent. Sorry, I don't buy that. I can do it right by my car and it disables(de-sychronize?) itself. Never had this problem with my 9-5. Hopefully this can be fixed with new replacements or reprogramming or something. Otherwise, it's just a really poor design.
