should warranty cover abnormal brake pad wear?

Have a '02 Aero w/ 62,000km and have the following problem:
The right rear brake pad(shoe) is 99% worn out and looks uneven and sharp in texture. Ont he other hand, i'm still on my first set of front pads, and the left rear pad looks close to new.
***Note: the right rear pad looks to be loose and i can actually see it protruding out of the caliper (but only noticed this now when cleaning my rims).
do you think this would be covered by warranty...or am i just out of luck?
