No, I think it is going to be very difficult to get any reimbursement for a failed cat on this particular car.
This mainly because the car have so many miles that the catalytic converter is very close to it final lifespan anyway.
A catalytic converter is not a part that is installed ones and never again.
Under good circumstance with a car that is maintained and running properly, the cat last a long time, 150-200K miles is not uncommon.
But what happens is that as older the cat gets, as more saturated with dirt/debris it gets and becomes more vulnerable for disturbances like a rich running engine or a coolant leak and things like that.
A brand new cat can take a lot of abuse and still be working good but a cat with 170K miles, a small coolant leak or a rich running engine can be the "last straw that broke the camels back" and it deteriorates to the point where it doesn't pass the smog requirements.
Have you taken the car to the smog station to verify that it wont pass?
Or is it a fault code logged that says the cat in not working properly?
Technically, a person or car company cannot sell a car that doesn't pass smog (at least here in CA), so it would be the sellers responsability to get the car street legal or sell it as non op.
