40K on a set a tires is pretty long especially for performance tires. Most likely at 40K your tires are worn like the guy said. The way to tell is to measure the amount of tread left on the tire. You can google tread depth to find simple ways to measure the depth like using a penny as a guide.
From Goodyear: "Place a penny into a tread groove with Lincoln's head upside down and facing you. If you can see the top of Lincoln's head, it's time for a new tire."
Depending on the tires they can run between 10K - 60K miles on a set. You can read reviews on Tirerack concerning tread life for various tires. It's a good resource to find out about tires and read reviews. Often you can leverage their pricing to have a local shop match their shipped price.
