What exactly did your indy "evaluate"? I dead battery is a dead battery. $240 seems like robbery. I'd be replacing the indy, too.
Most dealers, when selling used cars, turn into any other used car salesmen. For them all CPO means is that they get to charge you 3 hours of labor. There is no way to verify if they actually did all the checks unless you are there the whole time. Even then they can fudge the paper-work. Having said that, I would've asked for new battery and tires before buying a car with 40K miles on it, CPO or otherwise.
