broken front axle

Need your input please! My son's '99 9.5 wouldn't start the other morning - radio, windows, etc working fine, engine just wouldn't turn over; it was jumped w/o response. So he had to have it towed. Now, the car has a running engine (fuel pump was the problem) but a broken left front axle!
Our driveway is a tight circle and the tow truck operator admitted to having had trouble positioning his truck in front of the car. Neither my son nor I could be home to witness the tow job but I noticed some metalic scape marks now on the driveway pavement. Apparently the tow truck operator delivered the car to the mechanic's shop and left the car in a place where it could be worked on. So the initial problem was fixed without moving the car. When my son went to pick up the car and drive it away, the axle broke; he never even left the mechanic's property! My mechanic was going to look for signs of the car having been improperly pulled by the axle, presumably to position the car better. But unless some definite signs are there what recourse do I have? Is is really coincidental (as the tow company will argue) that the axle just happened to have snapped at this time, when the car was otherwise driving fine? Any thoughts, advise, suggestions??? Many thanks!
