You could also go the PayPal route and file a claim (if you used PayPal to purchase). This has worked twice for me. You will have a list of reasons why you are filing the claim for funds back, and one of them was "Item not as advertised" or "Item misrepresented"...etc.

You will have to communicate with the seller through PayPal's system and they will have a chance to communicate back with you. This is monitored through PayPal and things usually do end up in the buyer's favor.

I purchased a 19" Planar Touch Screen LCD monitor once for almost $1000 and was given a used unit when it was supposed to be brand new. The touchscreen wouldn't calibrate and that was obviously why it was being sold. PayPal refunded me the money and I also got to keep the monitor.

Worth a shot.
