So long as the fluid level is above the minimum, it is safe. At least on my 2002 there are two sets of level marks - one for hot fluid, one for cool fluid. I think the appropriate fluid temperature for each set of marks is also indicated.
That said, 4 quarts of fluid takes my '02 right to (but not above) the "max" line on the trans. This is very convenient as I don't have a partially filled bottle of trans fluid hanging around.
I think the book calls for 3.5 liters, which is between 3.5 and 4 quarts.
