Well, after some more investigation (and a bit warmer weather) here is the deal.
As someone else has mentioned, there is some plastic around the rotating locking metal in the lock. It turns out that this plastic can bind and the rotating lock with not fully unlock / rotate (even though the hatch will open) and then when you go to close, the channel is missed and the force rotates to the lock position even though the hatch is not closed (misses the metal locking bar on the frame).
The field fix for this is WHILE HOLDING THE HATCH HANDLE OPEN, take a screw driver or the like and try and move the rotator open. You should be able to do this, but mine was really stuck. There is a switch in the middle of the metal in the 12:00 position of the rotator, so be careful of that.
So, I could not get the rotator to "snap back" freely when opening I decided to remove the plastic around the metal. This took a bid and I have to remove the rubber trim on the lock and cut back some of the hard plastic on the lock to remove the plastic around the rotator. You would have to remove the lock to do this. I did, but now you will not.
Another fix would be to replace the lock, not too bad but have to remove the hatch inside cover and deal with 3 control wires.
