Actually the DOT regulation if I recall correctly, is that you cannot have more than 4 lights (of the type that cast a beam down the road) illuminated on the front of a vehicle at any one time. So with a 9-5 with incandesent headlights (2 functioning lights in each headlight), it is illegal to have the fogs working with the bright lights. If you have Xenons then it really isn't illegal because even on high beam with the U.S. setup you still only have 4 lights.
It depends on the dealer by the way, both my 2000 9-5 Aero and 2003 9-3 SE convertible were reprogrammed that way, at the 30 day service. Of course the 9-3 is legal that way (only one bulb in each headlight) and the 9-5 isn't.
