But, with instant on radar, the officer is still supposed to estimate your speed first and use the radar to confirm it. If you come around a blind curve and are immediately in the beam of an instant on radar, thereis very little chance that the traffic officer first determined that you are speeding and only then confirmed it with radar. I am not advocating speeding,but if you get stopped for a few miles over and raise that defense, you might get a ticket thrown out.Most police know that the proper procedure is to use the radar to confirm an estimated speed, not to sit there with the threshold on the lock in set to the speed that they want to get you at. If you try that argument when you are getting written up for 20 or more over, forget it. The cop will simply state that s/he did first estimate your speed.
