My name is Katie-Nicole Marble. I am a 19 year old and have just attempted
to purchase my first car. After two years of hard searching I have found the
car of my dreams, a 1989 SAAB 900 turbo convertible at Independent Auto Sales
of Lancaster, NY. The asking price was $4500 and the dealer offered $1500
for my trade.
I first took the car for a test drive on Wednesday, May 23 and noticed that
second gear needed adjustment and the lack of a security code left the audio
system inoperable. Later that same afternoon my father took the car out
himself and told the dealer that the passenger side wheel bearings need
replacement and the hood release cable would need also replacement. The
dealer agreed to these repairs and the next day I put down my $50 deposit.
On Friday, May 25, after an afternoon at the bank with my grandfather who
cosigned on this, my first loan, I paid the remaining balance plus taxes and
fees in cash for a total of $3240. Everything seemed to be going smoothly.
On Tuesday May 29, I recieved a call from the dealer that after some work was
done to the car that the passenger side window had mysteriously stopped
working. I let the dealer know that the window was working when I test drove
the car and his response was "Well, dear, I'm not fixing them." My father
stopped in to speak to the owner to try to resolve this issue and a verbal
conflict persued. The dealer claimed he was "loosing money" and would do no
further repairs. Reluctantly, I said I could deal with a faulty power window - I just wanted THIS car. I have finally reached my boiling point tonight when I received a phone call, at 10:00pm from Lorainne, the owner's wife, stating that the power top has also mysteriously stopped working and that they will not relinquish the car to me.
I do not understand why I should be responsible for repairs to the car that
were not of my fault or to be left without a car because a dealer agreed to a transaction that he now regrets. All I want is my car. I feel as a 19 year old female that I am being taken advantage of and that the owner has taken advantage of the fact that he now has cash-in-hand. I am pleading with you to possibly give me some guidance because I don't know where to go. I'm at my wits end.
