Because the US Department of Transportation insists that lights meet a certain specifications, and historically european spec lights do not. That has changed fairly recently, but this does not exempt old e-code lights. Do know that some states do not comply with Fed DOT specs - automobile lighting is ultimately controlled and legislated at the state or local level... for example, I'm pretty sure e-code lights are specifically legal in Washington State. In California, it's a major grey area as state law only describes the color, position and wattage of forward facing lights, and not its compliance with Federal Law. I got my '80 900T through state inspection with e-code lights, for example.
Honestly, I'd be surprised if any peace officer stopped you for your headlights. As long as you've got the right wattage bulbs in there and they're properly aimed, I think you'll be okay - at least in California, people get away with a lot worse. If you do, I'd feign ignorance and you'll probably end up with a warning or a fix-it ticket.
