I have worked in Human Resource management for over 20 years and I find it hard to believe that any company would be so stupid (not to mention unethical) as to break the law and discriminate against an employee due to their military or reserve status. Remember that anyone can file a lawsuit in this country for just about any reason. Typically, employees who file these actions really do not have a case and were terminated, disciplined, demoted or what have you for reasons completely unrelated to what they are claiming. And only a tiny percentage of claims are ever found to be valid by either the courts or the Equal Employment Opportunity Commission.
I don't know all the facts since I do not work for Pep Boys, but these cases happen sometimes - I have been involved in a few - and it is ultimately up to the courts to separate wheat from chaff. This gentleman's case sounds like chaff to me. I can also imagine that Pep Boys has been flooded with letters, phone calls and emails about this issue, so it is not at all surprising that a form letter has been carefully crafted by the company in response.
If guilty of discrimination in any form, any company should pay dearly, and at a time like this, the type of discrimination being alleged would be particularly heinous - if Pep Boys actually fired him for that reason. I guess I am saying I am skeptical about the claim!
