release the latch. Put the back seat down and grab a screwdriver. The latch on the bottom of the hatch (on the floor level of the hatch) can be popped open with the screwdriver. I forget which way you need to press down on it but you can figure it out.
Then, once the hatch is open, take off the trim/padding on the inside of the hatch. This is done by removing all of the speed screws and then pulling the padding away. Don't worry, it won't rip and it is easy to put back into place. Once that is out of the way you'll see the box that contains the latching/locking mechanism. Take the cover off. There is a small flat peice (slide) that slides to contact the peice that actuates the latch at the bottom you just poppped with the screwdriver. This peice gets out of adjustment. Sorry the description is so vague.....my intent is to just get you there and then you'll see how it is supposed to all work. Easy to fix....no parts needed and only takes about 15 minutes to do it.
