Technically, I think the smog stations here in CA are suppose to fail the car if it is holes in the exhaust system but they usually don't.
Different States have different rules though.
I don't think the hole (and introduction of extra oxygen) would make the gas readings take off in the wrong direction as long as it happens after the oxygen sensor. It would probably read cleaner because of the extra air.
