Well, the K&N filter is not a good choice for smog test anyway since it takes all the air from a hot engine compartment instead of from outside the inner fender where the snorkel to the original filter box gets the air.
So here you are loading the engine with preheated air when testing so that the combustion temp goes even higher.
On the Volvos that use preheater thermostat in the air filter box you can fail or pass all depending on if the thermostat has gone bad, allowing preheated air from the exhaust manifold to enter the engine. That's how close it can get sometimes with the NOx gas.
But even the trip back and forth and maybe that he took the car up for test right away when you came back could have gotten the cat nice and hot and performing much better.
