The law is not retroactive, so it's essentially impossible for a smog tech to tell whether you're compliant or not. How is he going to know whether your cat was installed before or after January 1 2009? He's not. This only affects new, professional installations where a professional is only allowed to sell/install correctly certified cats. If you're working at home or out of state, you don't really have a problem - unless your peeping Tom next door neighbor happens to work for CARB/CalEPA...
For the record, it IS a ploy to get more money. California doesn't allow/disallow equipment based on technical merit, it judges based on fees paid and the ability to properly prepare paperwork.
