You won't run into any legal trouble if you decide to deal with the smog check yourself after you have bought the car. You might only loose on it monetary if it turns out to be that the car needs extensive work to pass smog.
Actually, it is probably more common among private low cost car sales that the seller pass along the buck to the buyer hoping that the buyer don't know about the smog law.
But technically and legally, the seller has to provide a smog certificate.
