The seat pad and the back pad are in series. If one is broken, there will be no current flow and the seat won't get warm.
Now, IF somehow there was a short-circuit and the lower pad was out of the circuit, but the upper was still working, then yes, you would have a problem. If you are feeling substantial heat from the back but not the seat, stop using the heater.
The heater works by sensing the temperature in the seat - it applies 12 volts if the seat is colder than the setting, and cuts off the voltage when the seat gets hotter than the setting. If you aren't heating the portion with the sensor, the seat heater won't know when to turn off.
