The rubber part is really only a cap that sits on top of an adjustable nut and bolt arrangement. As I recall, you have to pry the rubber cap off, and get underneath the sheet metal by removing the covering in the trunk.
I had to do this on at least one of my 9Ks. It was several years back so I don't remember it exactly.
I'm not sure this logic is right, but it seems that the stops put a little upward pressure on the hatch. So when you pop the latch that pressure keeps the latch from "re-latching." That's maybe why this happens more more when it's cold out --the rubber shrinks a little and there's less upward pressure. Just a guess, but adjusting the stops a little may help.
