catalytic convertor EPA regulations

Dynomax has some stuff on their website (http://www.dynomax.com) stating under what conditions a catalytic convertor may be changed. The installer must also do all this paperwork. They also state that EPA regulations prohibit the removal of a properly functioning cat. Since I'm considering upgrading to a freer-flowing cat, have any of you had to deal with this issue? My old cat looks to be made out of rust, but I haven't examined it closely enough to see or hear if there are any holes. I can easily do the installation myself, but the welding of stainless flanges is beyond me (Carsound cat looks like it comes without them). Would my exhaust shop be mandated to investigate whether the installation is legal, since they are preparing one for me, and just how rusty can mine get before it can be declared too rusty? There's no state emissions testing in Wisconsin, but should I investigate having that done by a private shop and hope for the worst?
thanks.
