If it has no miles on it, it may be too early to expect it too work perfect. Auto trannies are very complex and are assembled with a bizarre "goo" that hold little check balls (like BB's) in place in the valve body. This goo in theory will be dissolved by the tranny fluid and mix with it at temperature. It is not uncommon for trannies to do some downright weird shit when they are first built. There are lots of little cavities in there and until it has enough miles on it to flush all of that out, fill the clutch packs (they actually absorb some of the fluid, sometimes enough to require adding a little), you just can't call it a bumb tranny. Drive it real easy for about 500 miles and it is likely that this will go away.
The last transmission I rebuilt and installed did a lot of wacky things. When first installed it only had forward gear, (even in reverse and neutral). Once it had enough fluid in it released whatever was stuck and magically started working fine. Then after several trips without event it started of in third gear all the time. It turned out to be some corrosion in an electrical connection. On two occassions during the first 50 miles or so of driving the tranny "bound up" (tried to engage two gears at once). I was very concerned, about ready to consider it a failure, after all i had heard that particular tranny was not only trouble-prone but difficult to rebuild.(it was a mazda 626) - but other than the first day or two I have had no troubles since (over 1000 miles now)
