Justification from K&N tech. guy attached below.
Small difference in width and sealing element thickness. I guess O.K. to use thinner gasket if you pinch the clamps to add more binding force, but obviously they have a specific one designed for '99 air-box.

33-2663 has dimensions of 10 15/16" x 6 1/4" with a 1 3/16" thick seal.
33-2166 is 10 15/16" x 6 1/8" with a 1 1/8" thick seal.
They have slightly different dimensions. Again, the most probable reason is
air box differences. Although the OEM part#s may be the same, can it be
verified that no changes were ever made between the 900s and 9-3s? A
different sealing edge or a plastic compound that flexes differently can all
affect the filter recommended. Paper and foam (amsoil) filters have soft
foam seals that can conform to small differences. Our filters have urethane
seals so they last for the million mile warranty. A small fractional gap is
enough to let dirt in so our filters are made to very exacting tolerances.
