Your last option. The theory is exactly the same as what has you angry. That warrant entitles you to a workmanlike, genuine repair. You did not get that. You got a breach of the warranty in each instance that still has not been cured. Practice makes perfect, but not in this case. The facts, that is, all of the details do matter. The term "good will" is a bit of a misnomer. While it may serve that purpose for letting you leave with a smile, it did not fulfill their, both Saab USA to provide the warranty and the dealer separately for poor workmanship, contractual obligations to you. Rather, part of the goal is to have you feel that you have been the beneficiary of an act of grace rather than the other parties even admitting that there is a continuing contractual obligation when the warranty has been breached in the past and that breach is the cause of the current problem. If it were me, I would line up all of my ducks, and speak to dealer first. Second, try Saab USA, fully documented, again. You may want to do a consult with an attorney familiar with consumer protections statutes, both federal such as Magnuson-Moss, and whatever state law protections there may be beyond the Uniform Commercial Code and common contract law. It usually does not pay to engage the attorney for a court case, but the advice may make the difference. Your state attorney general may have a consumer protection advocacy function which is also worth exploring before suing. Lastly, get the job priced at the dealer and an independent for the full repair, and then go to small claims court. Facts, facts, facts. Both court decisons and/or the persuasiveness of your entreaty to the dealer and Saab depend on the documentation you can gather. It might do them all well to know that you WERE thinking of a new 9-5 until your current car, and your precious time to deal with it, was again the victim of failure to live up to the warranty. Think what it does to the resale value if the heater and AC cannot be used properly. Hopefully it does not go that far.
