The difference is between 1995 vs. 1996. OBDII (1996 and later) has many more things which turn "on" the CEL, including (apparently) disconnection of components of the SAI system. On 1995 models disconnecting/removing the SAI system does not affect the CEL.
As far a emissions tests, I doubt it would have any effect, since most states I know test only when the car is warmed up, when the SAI wouldn't be running. It's just designed to help the catalytic converter run more efficiently at cold start by adding extra O2 to the exhaust, since mixture is rich when cold and emissions are higher.
Remember, the solution to pollution is dilution...at least that's what the SAI designers thought.
