In most states, the Insurance company has to give you RETAIL value, beofree negotiation. In other words, they have to call the local dealers, find similar cars, and give you what it would cost you to walk in and buy the car from a dealer, with NO negotaiton. They can't expect some (unknown) level of negotiation on your part. They also can't rely on book retail value as that is the negotiated value when the sale completes - not the asking price.

Again, qualified with "in most states", they have to give you the above amount, plus the sales tax, registration fees if they are value related, etc. It's best to call the State Insurance Commisioner and find out what you are entitled to. The Insurance companies are known to forget a lot of things unless you ask for them.

Don't be shy - the Insurance Company will screw you out of every dollar they can. Find out your rights, demand what's due to you.
