Just wanted to give a heads up about these winners...
Back in August, I had been trying to sell my father's Tahoe for a while, and had it in a local want-ad paper. These sleazeballs apparently troll want-ads looking for an opportunity to defraud people. I get a call from them mentioning that they had seen my car, and for 89.99, they would run it in their on-line used car lot "The Big Lot" for 3 months - if it didnt sell, I get my money back. I was tired of trying to sell this thing, and wanted it off my back, so I agreed. 3 months come and go, I get a grand total of 2 calls, and the truck didnt sell. So, I fill out their form, which had to be sent back within 10 days of the 3 month deadline, and had to be notarized, and send it in. 3 weeks go by, and on Thursday, I call to see where my money is. I'm told that I'm not getting any money since I didnt get it properly notarized - they claim that I need a stamp and a raised seal. Flat-out not true: the stamp is for prestige and convenience, NO LEGAL SIGNIFIGANCE. Not here in NY where I am, and not in VA, where they are. (I'm in my last semester of law school, and have been a law clerk at a large firm for 2 years now - free lexisnexis - yeah!) So, I call them back, ask once again for my money. This time, they admit that the notarization was valid in NY, but it has to be stamped + sealed if it is to cross state lines. Again, not true, and almost funny; whats next? I need a seal because it's Friday and I'm wearing green? I ask if I can resubmit the papers with an acceptable seal and get the "Oh no sir, the deadline has passed, theres nothing we can do..." routine. By now any doubt about their motives have vanished - they figure (probably accurately) that noone is going to pay a lawyer $100 to get $89.99 back, so they just find a nit to pick, deny the refund, and 99% of the people go away 89.99 poorer, with nothing to show for it.
I filed complaints with VA and NY AG's offices, but I dont think my claim is at the top of their priorities.
Not sure where I'm going from here, but I think a small claims action for a couple hundred bucks sounds good. I sue, they default and I burn em at their own game.
Saab Content: Found out today that the head I just took off my 83T is cracked. Figures.
