The insurance company is American Express, there is no personal agent or writer... do you think E&O would still apply here?
From where I stand, at the very least I've lost $4000 in Blue Book value, 9 mos x $150mo in storage fees, a $221 registation fee, and 9mos x $160mo in insurance premiums... That ultimately doesn't take into account the fact that I had to fork out $900 to get the a/c fixed on my Suburban (the Alfa is my "a/c car" :) and I lost use of the vehicle entirely during this period. I don't really care about "incidental damages" or fixing the 'burban's air because it needed to be done anyway, but does it sound unreasonable to go after them for the loss of value during this period?
I spoke with a friend who's pretty knowledgable about this stuff and his opinion was that the letter from AmEx to the DMV that detailed their error is pretty damning evidence, conclusive even... My issue is that I no longer have an attorney on retainer (those were the days...ugh) so "getting started" means forking out some dough. I am not interested in throwing money at a lawyer if it isn't almost certainly gonna net a positive... y'know?
