So have the guy apply for benefits, and then see what happens. If denied, then he has a federally mandated right to an administrative hearing to challenge the decision. While unemployment insurance benefits are a federally mandated program, the mechanisms and rules for who might be disqualified or not vary tremendously from state to state. In NY, for instance, we have the fault principal down to a religious science, s.t. if the employee was at fault, such as disobeying an order, then he is disqualified period. My understanding is that in neighboring NJ, the at-fault employee has a penalty period of around five weeks and then benefits flow. BTW, underperforming is not fault, at least not in NY. As long as they followed instructions and did their best, they were not at "fault." So, put the horse before the cart and apply. Just have your friend be aware that the appeal period can be as short as 20 days. Legal aid and many private practitioners are familiar with your state's rules and can offer expert representation to those denied.
