Although the commonly thought of reasons; change a wet diaper, quench a thirst, provide a bottle of formula, retrieve a favorite stuffed animal, are decades behind me. This time it was my oldest, the almost a lawyer son, calling on the phone at 3:00am to excitedly tell me he just received notice that a law journal had agreed to publish his first legal opinion. (Slight boast here, but the Saab connection comes later) The University of Texas (a top 25 law school) has accepted his submittal for publication in their Entertainment Law Journal. I was groggy but I think that is what he said.
He explained his paper to me at Thanksgiving, but not being a music major or legally trained as he is, my interpretation may be a little off the mark. Effectively, he examines the implications of posting transcribed guitar tablature from copyrighted songs on internet web sites. He argues in this opinion that if these guitar "licks" are posted as snipets, in a forum where discussion takes place, for the sole purpose of educating the viewers, that the educational excemptions to copyright infringement should apply.
Now we can see the Saab connection! This same argument could be extended to the posting of copyrighted repair manual pages on Saabnet and similar sites. Posting of snipets only, with discussion, for educating the viewers/readers, should be OK. Conversely, posting of the entire manual, with no discussion, for free viewing by anyone, would constitute infringement.
Disclaimer: This is only the researched opinion of a third year law student and has not been presented in any Court to be supported by decision.
I hope his publication will assist with him securing a job upon graduation in the Spring.
