Mike, of all US governmental agencies, I'd have to say that the FAA/NTSB are to be respected for their scientific and common sense approach to safety. Their determinations of proper clearances between aircraft and obstacles, and between aircraft, are based on such factors as real world accident data, ability of a pilot to fly a precise approach in severe weather, air traffic control abilities, and probably a bunch of stuff I don't understand. Before you criticize this city attorney, keep in mind that this is a very complex field (aeronautics), filled with true experts, with very high stakes (human lives). This developer apparently thought it would be easier to ask forgiveness than permission. Oops.
