My son made 2 mistakes. #1. Didn't drive a Saab. (OK, the goofing off stops here). #2. He got stopped by the police for driving on an out of state license plate and out of state driver's license. No traffic violations other than that.

California state law says students UNDER 24 can use their home state. We didn't know about the 24 year old part.

A lawyer we saw shopping at Home Depot said to take it seriously because the offense is a criminal misdemeanor, at least the driver's license part. This seems to be confirmed on the internet. If true, this means my son could get a criminal record. I don't think he would have to go to prison, but the criminal record could sink his career.

One policeman said he never heard of the charge not dismissed after you show the judge your new California driver's license. However, a criminal record is so bad that we have to be 100%, not 99% certain that this will happen.

The stupid thing is that my son told the DMV that he was going out of state to study and they said to give them the California (out of state) address which they printed on the non-California driver's license.

The lawyer we saw shopping at Home Depot said we need a lawyer. He said that California requires that my son be provided with a public defender, if requested. Should we go that route or hire an expensive private lawyer (ouch!)
