The dealer you bought the car from should refund your money immediately (or give you back your uncashed check). They're the ones who need to do the work to straighten out the title (e.g., getting a signature from the original owner). No way he should've sold you a car without a clean title and if they balk at giving you back your money, that's where the lawyer comes in.
And, as I understand it, there's another dealer the original owner sold the car to. Are you supposed to do the grunt work with them too? No way!! And -- worst case -- what if the original owner declines to sign the title for whatever reason? You're out of luck at that point. Again, you must get your money back from the selling dealer.
For the rest of us, it's worth the extra $$ to do a title search on any used car purchase before plunking down the money. Caveat emptor.
