because the bolt was overtorqued. I agree that just leaving the washer out is not in the category of gross negligence. But overtightening the bolt (probably to stop the leaking after the washer was left out) IS gross negligence that can easily cause over $1000 damage to the car. I would not take the car back to them because they clearly do not understand how much torque to apply to a bolt into an aluminum case.
This kind of story has been repeated many times on this BB - usually a Jiffy Lube or similar type of place. Jiffy Lube has seen it happen so many times they no longer fight - they just pay up.
