DP already "touches" the trans

You don't want the DP to brush up against the trans because it will vibrate.
But the stock DP bracket is bolted to the trans just a few inches from the DP, so plenty of heat is already conducted from the DP to the trans. It's conceivable that more heat is conducted to the trans via the bracket than if the DP were touching the trans because there's a good amount of contact between the DP and bracket to aid conduction.
This is not to mention the radiated heat that you get no matter what.
If you've got the DP clearanced to fit now and it's just banged in a bit to do so, I'd just call it good. If you mashed it in to within half its diameter, it's time to cut/weld/re-route.
If you're really nervous, send the DP to Swain Tech and have them coat it.
