Some companies sell what are called 'cold air intakes' or CAI, they are usaully defined that way because they are not in the engine bay, rather mounted in the fender wells, usually right behind the fog lights. It's reasonable to be concerned that a CAI could get submerged, though unlikely if you are at all careful.
Nick's intake is what you would call a short ram, which replaces the airbox, but keeps the filter in the stock location. In this case you'd really to be in a very deep puddle to pull water in, infact things like your turbo would already be submerged and your car would basically be trashed, whether or not you intake water...
Also because it is in the stock location, if you are deep enough to draw water in to the open filter, you would have already drawn water in through your stock box.
