I had an accident not long ago: I pulled out from behind a line of cars at a light, waiting to turn left (you could turn L or go straight from this lane) The other 3 lanes next to me were wide open. I even have a blindspot mirror to check for oncoming cars. Some guy came flying along in his VW Corrado in the second lane over, doing about 60 in a 35, moving into the lane I was trying to get into. I was almost completely in the lane, when the left side of his car passed along the right front of mine. I just had scratches to my car, but he had huge damage all along the side of his car. The police and insurance company were able to determine from examining our cars that he was at fault. They never paid him a dime.
File a police report, tell you insurance company what happened. It will get handled... that is what insurance is for. Just by telling them the situation, instead of them hearing from some other insurance company all about it in some other point of view, will greatly help your situation. You don't have to file a claim for your damages, and tell them you don't want to. You CAN file a claim for damages with his insurance company (which is what I would do) What kind of car are we talking about, by the way?
