I had exact same problem; wp replacement at 180k at time on 03 Linear SS. Dealer replaced pump but whine remained, after knowing something wasn't right, I took the advice of the good people on this board and immediantly went back to dealer. They went back and replaced the tensioner and repaired the chain whine, free of labor charge, I was only out the tensioner. While I'm an attorney, I'm in criminal, not civil, so IT IS MY OPINION that the mechanic could be on the hook for new motor if a failed chain is the 'but for' cause of engine failure and that failure happens in a short time. Now, this varies by state and I'm not giving legal advice (board of professional responsibility requires these disclaimers) but I think explaining to the mechanic he did your car a disservice on the repair he may understand. Now, clearly he isn't acting with malice and it is probably an honest mistake, my mechanic did it and he is.a great person, but you have leverage.
I would keep a paper trail and let the issue be memorialized that the whine occurred after the repair. I would get her fixed, whines are always bad (unless you are driving a Subaru manual, then it's normal)
