As I understand the issue, the problem is not a faulty part but a bad design. This isn't like a defective switch or bad batch of modules, the problem is having a complex electrical component sitting on a large heat source. In order to issue a recall, there'd have to exist a compatible replacement which isn't subject to the same failure. If such a product existed, a lot of us would be buying them on eBay rather than waiting for Saab to replace ours for free.
So, even if NHTSA told Saab to do a recall asap, there'd be no part that Saab could use for a replacement. They clearly have tried to rectify the problem with improved DICs and software, but there are still reports of failures even on newer models.
I suppose Saab could recall all 9-5s and give us Infiniti G35s as replacements -- oh wait, didn't they recall a bunch of those because engines would stop running?
