The warranty clock stops when you file a complaint, not when they finally get around to acknowledging the problem (within reason). Go straight to the dealer and present him with a letter, signed in the blood of your attorney, stating what the transmission has done. That establishes your warranty claim. If it turns out to be nothing, no problem. If it turns out to be something, then you don't have to go through SaabUSA for a clarification of whether the claim will be honored.
And I believe the transmission fluid should be kept fresh. Bearing in mind that a little less than half the fluid is removed in a simple drain and fill, and also that the Aisin Warner transmissions have a reputation for great longevity (a reputation that you may challenge), my regemin has been to perform the first drain-and-fill at 30,000 miles, then repeat every 10,000 miles. That's with towing the convertible 2000 miles out of every 10,000. Over mountains.
