Option 1: Tow the car home and notify the insurance company that the car isn't going anywhere until a settlement is reached and you are paid. Second, do your own homework and determine the real value of the car and the cost of a rental necessary until you replace the car. Deal on your terms, not the insurance company's.
Option 2: Tow the car to a body shop of your choosing and get an estimate regarding cost to repair. If this is feasible, inform them that this is the path you intend to take. Again, don't be bashful about asking for a rental car.
In either case, once you've determined a fair settlement (for you) inform the insurance company (in writing of course) that they have a month to settle and that you are prepared to proceed on a legal basis if they'd rather use that approach.
I used the above tactic and got every dime I requested.
